Service agreement

1. Parties and scope

This agreement is between Ember Studios ("we") and the customer who places the order ("you"). It covers the design and development of the website described in your order: the package, the extras you selected and the requirements you give us in the onboarding questionnaire. The agreed scope is recorded with your order.

2. Who can order

You must be 18 or older to order. If you order for a business, you confirm that you may act on its behalf.

3. Ordering and payment

Prices are shown before you order and are paid in full at checkout through Stripe. The price shown is the total you pay for the work described; there are no hidden fees. Your domain name and web hosting are not included: you pay for these separately to a provider you choose. Your order is confirmed when the payment succeeds. We never see or store your card details.

4. Cancelling within 14 days (consumers)

If you order as a consumer in the EU, you may cancel within 14 days of your order without giving a reason. At checkout you ask us to start work straight away. If you cancel within the 14 days, we refund what you paid minus a proportionate amount for the work already done. Once we have fully delivered the website, you can no longer cancel under this right. To cancel, send us a clear message (see section 14). The refunds page explains this in plain words and includes a text you can use. Business customers do not have this right.

5. Your input

We start once you have completed the onboarding questionnaire. You confirm that you have the right to use any text, images, logos and other material you give us.

6. Delivery and delays

We give an estimated delivery date for your project and show it in your project dashboard. If we expect a delay, we tell you, explain why and show the new estimated date. If we genuinely cannot deliver the agreed website, you are entitled to a refund under section 10.

7. Revisions

Your package includes the number of revision rounds stated with your order. One submitted set of feedback counts as one revision round; drafts you have not submitted do not count. Additional revision rounds can be bought separately. Fixing defects, or functionality missing from the agreed scope, is not a revision round and is free of charge.

8. Approval and delivery

When you approve your website in the dashboard, we record the approved version and the time of approval. After approval and full payment, you can download the website files with setup and deployment instructions. Download links are personal and expire shortly after they are created.

9. Attribution

Every website we deliver includes a small, visible footer credit, "Website by Ember Studios", linking to https://emberstudio.cc. You agree to keep this credit on the website unless we give you written permission to remove it. We do not include any mechanism that disables your website.

10. Refunds

Because your website is custom work made to your specifications, there are no change-of-mind refunds for completed custom work, where the law allows this. If a delivery is delayed, we will communicate with you and try to resolve it. If we genuinely cannot deliver the agreed project, we refund you. Refunds go to the payment method you used. Nothing in this agreement limits the mandatory rights and remedies you have under consumer law.

11. Maintenance plans

Maintenance plans are optional and billed every month or year, as shown when you start one. You can cancel at any time from the Maintenance page in your project dashboard. The plan then stays active until the end of the period you already paid for, and no further payments are taken.

12. Ownership

After full payment, you may use the delivered website for your business. Third-party components (such as fonts, libraries or images) remain subject to their own licences.

13. Liability

We carry out the work with care and skill. Our liability is limited to the amount you paid for the order, except where the law does not allow such a limit.

14. Privacy and contact

We process your personal data as described in our privacy policy. Questions, cancellations or complaints: info@emberstudio.cc, or use the contact form on our website.

15. Changes

We may update this agreement for new orders; the version you accepted stays recorded with your order.
